PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the Missouri Pacific Railroad, that:
1. Carrier violated the Agreement betweent the parties when
on February 18, 1958, it declared abolished the position of car
distributor at Nevada, Missouri, without in fact abolishing the work
of the position and transferred the work of the negotiated position
to employes not covered by the Agreement.
2. Carrier shall now compensate N. F. Barksdale, the incumbent of the position, any and all money loss he shall sustain
beginning with February 18, 1958, including any expenses involved
in working at other locations, until he is rightfully restored to his
former position of car distributor at Nevada, and,
3. Carrier shall compensate all employes adversely affected
by this improper job abolishment, including their loss of pay and
expenses.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing was waived and under date of December 31, 1959, the
parties jointly addressed a formal communication to the Secretary of the
Third Division requesting withdrawal of this case, which request is hereby
granted.
AWARD
Claim dismissed.
