NATIONAL RAILROAD ADJUSTMENT BOARD
PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the Missouri Pacific Railroad, that:
1. Carrier violated the Agreement between the parties when
on March 24, 1958 it declared abolished the position of Car Distributor at Wynne, Arkansas without in fact abolishing the work of
the position and transferred the work of the negotiated position to
employes not covered by the Agreement.
2. Carrier shall now compensate E. F. Straub, the incumbent
of the position, 8 hours at the pro rata rate of pay for each work
day of the position beginning with March 24, 1958, and any expenses
involved in working at other locations, until he is rightfully restored
to his former position of Car Distributor at Wynne and,
3. Carrier shall compensate R. E. Bridger 8 hours at the
pro rata rate of pay for each day he is prevented from working his
position of third trick telegrapher at Paragould on account of this
improper displacement, and any expenses incurred by him as a
result thereof, and in addition,
4. Shall pay each employe adversely affected by this improper
abolishment any losses sustained both salary and expenses.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing was waived and under date of December 31, 1959, the
parties jointly addressed a formal communication to the Secretary of the
Third Division requesting withdrawal of this case, which request is hereby
granted.
