BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
ELGIN, JOLIET AND EASTERN RAILWAY COMPANY
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the effective Agreement when it
required Track Foreman Glowiske and the members of his crew to
start and end their day's work at other than their regularly designated assembling point, that is, the tool car located in the vicinity of
the coke plant in the Carrier's Gary Mill Yard.
(2) In consequence thereof, Track Foreman Glowiske and the
members of his crew each be allowed two hours' pay at their respective time and one-half rates retroactive to the beginning of the
violation referred to in Part (1) of this claim and to continue until
the violation is corrected.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and
That no hearing thereon has been held, and under date of January 13,
1960, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
