PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
CENTRAL OF GEORGIA RAILWAY COMPANY
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express
and Station Employes that,
(1) The Carrier violated and continues to violate the rules of
the Miscellaneous Employes' Agreement of December 1, 1941, as
amended, when, effective with the close of business on August 31,
1955 and continuing since that time, without conference and/or
agreement on the part of the Employes' Representatives, it arbitrarily
and unilaterally abolished the position of Maid at Savannah, Georgia
Shops and contemporaneously therewith transferred all of the work
which had theretofore been performed by this employe for many
years to Laborers in the Mechanical Department and
which Laborers
are covered by the Shop Crafts' Agreement and that, therefore,
(2) This work shall now be returned to the Scope and operation of the above-mentioned Miscellaneous Employes' Agreement
and that,
(3) Lucy L. Collins, Maid, shall be compensated for all wage
and other losses incurred and that,
(4) This claim shall remain in effect until the above condition
and violation is corrected.
FINDINGS:
The Third Division of the Adjustment Board, after giving
the parties to this dispute due notice of hearing thereon and upon the whole
record and all the evidence, finds and holds:
That carrier and employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved
June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;

That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of
January 18, 1960, the parties jointly advised the Secretary of the Third
Division of their desire to withdraw this case from further consideration by
the Division, which request is hereby granted.
AWARD
Case dismissed.
