THE CHESAPEAKE AND OHIO RAILWAY COMPANY
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(a) The Carrier violated the Agreement when, on June 15,
1958, at Ore Pier 9, Newport News, Virginia, it required J. M. Ward,
Pier Clerk, Merchandise Pier No. 8, to perform the duties of Pier
Control Clerk, failing to afford preference for such work to Claimant,
Pier Control Clerk A. J. Frostick.
(b) Claimant A. J. Frostick shall now be additionally compensated for eight hours at time and one-half the Pier Control Clerk
rate of $20.07 per day.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of March 21,
1960, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Case dismissed.
