STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
1. The Carrier violated and continues to violate the Clerks'
Rules Agreement when it abolished the Storekeeper positions at
Sioux Falls, S. D., on August 17, 1953 ; at Madison, S. D. on October
16, 1953; and Dubuque, Iowa on April 3, 1953, and transferred the
Storekeepers' duties and work to employes not covered by the scope
and application of the Clerks' Rules Agreement.
2. The Carrier shall now be required to return the Store
Department work and the duties which were associated with the
Storekeeper positions at Sioux Falls, S. D., Madison, S. D., and
Dubuque, Iowa to Store Department employes covered by the Clerks'
Rules Agreement holding seniority in Seniority District No. 118, and
3. Compensate the following employes: E. J. Bahr, F. E. Lonn,
S. D. Brkljack, and all others affected as a result of the abolishment
of the Storekeeper positions at Sioux Falls, S. D., Madison, S. D., and
Dubuque, Iowa for all loss suffered from the date of abolishment
until the violations are corrected.
FINDINGS:
The Third Division of the Adjustment Board, after giving
the parties to this dispute due notice of hearing thereon and upon the whole
record and all the evidence, finds and holds:
That carrier and employes involved in this dispute are respectively carrier
and employes within the meaning of the Railway Labor Act, as approved
June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and

That hearing thereon has been held and concluded. Under date of
February 16, 1960, the parties jointly advised the Secretary of the Third
Division of their desire to withdraw this case from further consideration by
the Division, which request is hereby granted.
AWARD
Case dismissed.
