THE BALTIMORE AND OHIO RAILROAD COMPANY
STATEMENT OF CLAIM:
Claim of the General Committee of the
Order of Railroad Telegraphers on The Baltimore & Ohio Railroad, that:
1. Carrier violated the agreement between the parties bereto
when, on February 14, 1956, at 9:32 A. M.; February 15, 1956, at
9:12 A. M. and 2:55 P. M.; February 28, 1956, at 12:02 P. M.;
March 23, 1956, at 10:31 A. M. and 1 :06 P. M.; March 29, 1956, at
9:29 A. M.; March 30, 1956, at 9:53 A. M. and 1:05 P. M.; April 2,
1956, at 8:25 A. M., 12:43 P. M. and 1:13 P. M.; April 3, 1956, at
8:35 A. M. and 12:45 P. M.; April 4, 1956, at 10:22 A. M., 12:52
P. M., 3:10 P. M., 3:55 P. M., 3:40 P. M., 4:15 P. M. and 4:55 P. M.,
it caused, permitted and required members of the crews of various
work extras in maintenance service, employes not covered by the
Telegraphers' Agreement, to receive, copy and deliver Form A, and
to report their train clear of the main track at Curtis Yard to the
Operator at McCool, Indiana, which work was and is reserved solely
to employes covered by the Telegraphers' Agreement.
2. Carrier be required to compensate an idle telegrapher (extra
in preference) for pay for one day (8 hours) on each date hereinbefore listed.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing thereon bas been held and concluded. Under date of
March 31, 1960, the parties jointly addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
