FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES

COMPANY
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
1. Carrier violated and continues to violate the rules of the
Clerks' Agreement when it abolished clerical Position No. 36 at
Granite Falls, Minnesota and assigned the remaining duties of the
position to employes not covered by the Clerks' Agreement.
2. Employe James C. Wilcox, occupant of Position No. 36 at
the time of abolishment, shall be compensated for the difference between what he would have earned had the position not been abolished and what he has earned on other positions, plus any other loss
sustained by him as a result of Carrier's action, for October 20,
1958 and each subsequent day that the violation continue:..
3. Carrier shall compensate furloughed Employe Julian E.
Savageau for eight (8) hours at the rate of pay applicable to Position No. 36 for October 20, 1958 and each subsequent day that the
violation continues.
4. Carrier shall return the work of Position No. 36 as it existed prior to abolishment, to the Clerks' Rules Agreement and to the
employes covered thereby.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of April 28,
1960 the parties jointly advised the Secretary of the Third Division of their
desire to withdraw this case, which request is hereby granted.
