THE PENNSYLVANIA RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(a) The Carrier violated the Rules Agreement, effective May
1942, except as amended, when it used Clerk J. G. Rossiter, Jr.,
who is junior to the Claimant in service, to fill vacancies on position
Symbol F-1081, at the Pennsylvania Produce Terminal, Philadelphia,
Pennsylvania, Philadelphia Region, on the dates specified below.
(b) The Claimant, and senior clerk, B. F. Glackin, should be
allowed eight hours pay a day for March 23, 24, 20, 31, April 6,
7, 13 and 14, 1957. (Docket 227.)
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of April 19,
1960, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
