PARTIES TO DISPUTE:
BROTHERHOOD OF RAILROAD SIGNALMEN OF AMERICA
THE CHESAPEAKE AND OHIO RAILWAY COMPANY
STATEMENT OF CLAIM:
(a) That the carrier violated the Signalmen's Agreement by
assigning to employes not covered by such agreement the work of
constructing signal instrument houses fer the installation of CTC
signaling.
(b) That the following emptoyes who were holding seniority
rights and capable of performing the work, under provisions of the
existing agreement, should have been used to perform the work
described in paragraph (a) and that such employes be paid amounts
listed because of the Carrier's violation of the agreement in not
using them to perform such work:
W. F. Brady Leading Signalman 89 hrs. 1.09 per hr.
R. A, Hall Signalman 89 hrs. 1.04 per hr.
Boyce McMillon Signalman 89 hrs. 1.04 per hr.
F. E. Thompson Signalman 89 hrs. 1.04 per hr.
C. E. Altixer Signalman 89 bra. 1.04 per hr.
Carl Hinchman Ass't Signalman 89 hrs. .91 per hr.
H. A. Cyrus Ass't Signalman 89 hrs. .83 per. hr.
E. W. Cooke Signal Helper 89 hrs..79 per hr.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board jointly by the parties; and
That hearing thereon has been held and concluded. Under date of May
20, 1960, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case from further
consideration by the Division, which request is hereby granted.
