FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES

STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(a) The Carrier violated the Agreement when at Washington,
Georgia, it utilized the services of one G. J. Gresham, an employe
covered by another Agreement, to work the position of Clerk, Mr.
Aubrey Chafin while Clerk Chafin was on vacation.
(b) The Carrier shall now compensate Claimant J. P. Baker
eight hours at time and one-half the rate of $2.87 per hour for July
30, August 6 and 13, 1956; Claimant C. D. Page eight hours at time
and one-half the rate of $2.87 per hour for July 31, 1956, August 1,
7, 8, 14 and 15, 1956; Claimant W. R. Clary eight hours at time and
one-half the rate of $2.87 per hour for August 2, 3, 9, 10, 16 and 17,
1956; Claimant Z. B. Wilson two hours each day at time and one-half
the rate of $2.87 per hour for August 4, 11 and 18, 1956.
FINDINGS:
The Third Division of the Adjustment Board, after giving
the parties to this dispute due notice of hearing thereon and upon the whole
record and all the evidence, finds and holds:
That the carrier and employes involved in this dispute are respectively
carrier and employes within the meaning of the Railway Labor Act, as
approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of July
21, 1960, the parties jointly advised the Secretary of the Third Division of
their desire to withdraw this case from further consideration by the Division,
which request is hereby granted.
