STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(a) That the Carrier violated the Agreement when it dismissed
E. S. 1llcCray from service without just cause.
(b) Mr. E. S. McCray shall now be restored to Carrier's
service with seniority, vacation and all other rights unimpaired, and
compensated for all time lost on and after July 24, 1959.
NOTE: Reparation due claimant to be determined by joint
check of Carrier's Payroll and Personnel Records.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the
complainant party;
and
That no hearing thereon has been held, and under date of July 21, 1960,
the parties jointly advised the Secretary of the Third Division of their desire
to withdraw this case, which request is hereby granted.
AWARD
Case dismissed.
