STATEMENT OF CLAIM: Caim of the System Committee of the
Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and
Station Employes that the Carrier violated the agreement:
1. At Superior, Wisconsin, by requiring the BaggagemanJanitor on the 11:00 P. M. to 7:00 A. M. shift to call crews, thus
applying to the position of Baggageman-Janitor, an improper rate
for service performed, and by reason thereof;
2. The Carrier now be required to compensate R. W. Norberg,
Baggageman-Janitor, assigned hours 11:00 P. M. to 7:00 A. M., the
difference in rate of pay of $1.45 per day, account required to call
switch and engine crews for the date of February 28, 1969 and for
each and every day thereafter until this Agreement violation is
corrected.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of September 9,
1960, the complainant party addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
