BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
SOUTHERN PACIFIC LINES IN TEXAS AND LOUISIANA
(Texas and New Orleans Railroad Company)
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(1) Carrier violated the effective agreement
when it
failed to
provide extra gang foreman Arl Logan with proper accommodations
to
prepare his
meals from October 6
to October 22, 1958,
inclusive.
(2)
Extra gang foreman Arl Logan now
be reimbursed in the
amount of
$33.60,
which represents the expenses he incurred in
obtaining meals because of the Carrier's violation as referred to in
Part (1) of this claim.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was
certified to
the Third Division of the Adjustment
Board ex pane by complainant party; and
That no hearing thereon has been held, and under date of November
14, 1960,
the complainant party addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
