PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
GULF, COLORADO AND SANTA FE RAILWAY COMPANY
STATEMENT OF CLAIM: 'Claim of the System Committee of the
Brotherhood that:
(a) Carrier violated the current Clerks' Agreement at Somerville, Texas, when it established on August 22, 1956, position of
Overhead Crane Operator and gave the position a rate of $1.9025
per hour; and,
(b) That a rate of pay of $1.9575 per hour (plus any subsequent increases) shall be given position of Overhead Crane Operator
as of August 22, 1956; and,
(c) Claude Rhodes and/or other occupants (") of the position
of Overhead Crane Operator shall now be paid the difference between $1.9025 per hour and $1.9575 per hour (plus any subsequent
increases) from August 22, 1956, forward, until the violation is
corrected.
FINDINGS: The Third Division of the Adjustment Board, after giving
the parties to this dispute due notice of hearing thereon and upon the whole
record and all the evidence, finds and holds:
That the carrier and employe involved in this dispute are respectively
carrier and employe within the meaning of the Railway Labor Act, as
approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
(°) As reflected by Carrier's time rolls.

That hearing thereon has been held and concluded. Under date of
November 15, 1960, the parties jointly advised the Secretary of the Third
Division of their desire to withdraw this case from further consideration by
the Division, which request is hereby granted.
AWARD
Case dismissed.
