PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
THE PANHANDLE AND SANTA FE RAILWAY COMPANY
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(a) Carrier violates and continues to violate the provisions of
the Clerks' Agreement at Pampa, Texas, when it removes certain
routine and/or related work from the scope of the Agreement and
requires or permits its performance by others not covered by the
Agreement rules; and,
(b) Such work shall now be returned to the scope and operation of the Agreement; and,
(c) P. H. McCrate shall now be paid eight (8) hours per day
at the rate of time and one-half the respective rate of his position,
less what he is paid on such days for each Saturday and Sunday each
week from February 11, 1957, until the violation of the Agreement
rules shall have been corrected.
FINDINGS: The Third Division of the Adjustment Board, upon the
whole record and all the evidence, finds and holds:
That the Carrier and the Employes involved in this dispute are respectively carrier and employs within the meaning of the Railway Labor Act, as
approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing thereon was waived by the parties and under date of
November 15, 1960, the parties jointly advised the Secretary of the Third

Division of their desire to withdraw this case from further consideration by
the Division, which request is hereby granted.
AWARD
Case dismissed.
