PARTIES TO DISPUTE:
BROTHERHOOD OF RAILROAD SIGNALMEN
OF AMERICA
CHICAGO AND NORTH WESTERN RAILWAY COMPANY
STATEMENT OF CLAIM:
Claim of the System General Committee of
the Brotherhood of Railroad Signalmen of America on the Chicago and North
Western Railway Company that:
(a) The Carrier violated the current Signalmen's Agreement
when it denied the employes assigned to Lake Street Crew, Central
Crew No. 1 and Central Crew No. 2, 'Central Seniority District, the
right to work six (6) days during the week of February 18, 1957.
(b) The Carrier shall now be required to pay the following
employes assigned to the Lake Street Crew eight (8) hours at rate
and one-half of their respective rate of pay for Saturday, February
23, 1957: V. Brown, Gang Foreman; A, Schewe, Leading Signalman; B, Jemison, Leading Signalman; E. Irali, Signalman; E.
Homeyer, Signalman; J. Ong, Signalman; W. Kading, Signalman;
R. Miranti, Signalman; G. Duncum, Signalman; H. Bloom, Signalman; E. Peterson, Signalman.
(c) The Carrier shall now be required to pay the following
employes assigned to Central Crew No. 1 and Central Crew No. 2
eight hours at rate and one-half of their respective rate of pay for
Friday, February 22, 1957:

" -C. P. Lamb, Leading Signalman
" -H. F. Fyfe, Leading Signalman

FINDINGS: The Third Division of the Adjustment Board, after giving
the parties to this dispute due notice of hearing thereon and upon the whole
record and all the evidence, finds and holds:
That the carrier and employes involved in this dispute are respectively
carrier
and employes within the meaning of the Railway Labor Act, as
approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing thereon has been held and concluded. Under date of
December 5, 1960 the parties jointly addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
