PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
BOSTON AND MAINE RAILROAD
STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the Boston and Maine Railroad, that:
1. Carrier violated the terms of the agreement when, on Thursday, November 25, 1954, it allegedly blanked the positions of agenttelegrapher and assistant ticket agent-telegrapher at Malden West,
Mass., both seven-day positions, and failed to properly compensate
A. H. Smythe, Agent-Telegrapher, and W. C. Jones, Assistant Ticket
Agent-Telegrapher, for the work performed on November 25, 1954.
2. Carrier shall now be required to compensate A. H. Smythe
the difference between the eight (8) hours at the time and one-half
rate to which he was entitled, and the three (3) hours at pro-rata
rate which he was paid for work performed within his assigned hours,
and work performed beginning at 6:50 A. M. on November 25, 1954.
3. Further, Carrier shall compensate W. C. Jones for eight (8)
hours, at the time and one-half rate, to which he was entitled for
work denied him within his assigned hours, which work was performed by A. H. Smythe beginning at 9:30 P. M. on November 25,
1954.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of
January 11, 1961, the parties jointly addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
