STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(a) Carrier violated the current Clerks' Agreement at Chicago, Illinois, when it removed Mr. Roger T. Charnock from position of Ticket Clerk to which he was assigned without allowing him
sufficient time in which to qualify; and,
(b) Mr. Roger T. Charnock shall now be returned to the position of Ticket Clerk to which he was assigned; and,
(c) Mr. Roger T. Charnock shall now be paid a day's pay
at the prevailing Ticket Clerks' rate of pay for each work day,
Monday through Friday, of each week from May 27, 1968, forward, until the violation has been corrected, in addition to any
other amounts he may earn on any position he has been forced to
occupy as result of Carrier's improper action.
FINDINGS: The Third Division of the Adjustment Board, upon the
whole record and all the evidence, finds and holds:
That the Carrier and Employe involved in this dispute are respectively
carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing thereon was waived by the parties and under date of
February 23, 1961, the parties jointly addressed a formal communication to

the Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
AWARD
Case dismissed.
