PARTIES TO DISPUTE:
BROTHERHOOD OF RAILROAD SIGNALMEN
CHICAGO, ROCK ISLAND AND PACIFIC RAILROAD
COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of the
Brotherhood of Railroad Signalmen on the Chicago, Rock Island and Pacific
Railroad Company that:
(a) The Carrier violated the current Signalmen's Agreement,
particularly Rule 18, when it failed to compensate Signal Maintainer
Henry Shank with assigned headquarters at UD Interlocking, Joliet,
Ill., for a minimum call of 2 hours and 40 minutes at the punitive
rate of pay for service performed on April 29, 1958, when he was
called at 11:10 A. M. and completed his work at about 11 :30 A. M.
(b)' The Carrier further violated Article V of the August 21,
1954 Agreement when it failed to disallow the claim within 60 days
of the date that it was presented by the General Chairman to the top
officer of the Carrier for consideration.
(c) The Carrier now be required to pay Mr. Henry Shank for
a minimum call of 2 hours and 40 minutes at the punitive rate on
account of the above violations.
FINDINGS: The Third Division of the Adjustment Board, upon the
whole record and all the evidence, finds and holds:
That carrier and employes involved in this dispute are respectively
carrier and employes within the meaning of the Railway Labor Act, as
approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing was waived and under date of July 14, 1961, the parties
jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
