STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railroad Signalmen on the Chicago, Rock Island and Pacific Railroad Company:

In behalf of Signal Maintainer C. F. Hultgren with assigned headquarters at Root Street, Chicago, Illinois, for a minimum call of two (2) hours and forty (40) minutes on December 9, 1958, and a minimum call of two (2) hours and forty (40) minutes on December 10, 1958, at the time and one-half rate under Rule 18 of the current Signalmen's Agreement, when he was called for and performed work outside of and not continuous with his regular working hours.

FINDINGS: The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds and holds:

That carrier and employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21,1934;

That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;

That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and

That hearing was waived and under date of July 14, 1961, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
