STATEMENT OF CLAIM:
Claim of the General Committee of the
Brotherhood of Railroad Signalmen on the Chicago, Rock Island and Pacific
Railroad Company:
In behalf of Signalman F. W. Waters, assigned to the Silvis
Signal Shop, for the difference between his Signalman's rate of pay
which is $2.566 per hour and that of $2.626 per hour, or a 6c differential, under Rules 61(b) and 25 of the Signalmen's Agreement,
for each and every hour of work for four (4) hours November 30,
1959, and for eight (8) hours on each of the following dates: December 1, 2, 3, -1, 7, 8, 9, 10, 11, 14, 15, 16, 17, 18, 21, 22,
23, 24, 28, 29, 30, and 31, 1959, and for all subsequent dates that
he is used in this relay test room off of his regular assignment.
Claim is also filed under the provisions of Rule 14 of all the
time that he was held off of his own assignment as a Signalman and
used in the relay test room-absorbing the overtime which rightfully
belongs to the employes assigned to the relay test room. For four
(4) hours on November 30, 1959, and eight (8) hours per day for
December 1, 2, 3, 4, 7, 8, 9, 10, 11, 14, 15, 16, 17, 18, 21, 22,
23, 24, 28, 29, 30, and 31, 1959, and all subsequent dates that he is
held off of his regular assignment and used to absorb the overtime
of others. This to be paid him in addition to what he has been paid
for the above specific dates claimed and all subsequent dates he is
held off of his assignment.
FINDINGS:
The Third Division of the Adjustment Board, upon the
whole record and all the evidence, finds and holds:
That the carrier and employes involved in this dispute are respectively
carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;

That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing was waived and under date of July 14, 1961, the parties
jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
AWARD
Claim dismissed.
