STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railroad Signalmen on the New York, Chicago and St. Louis Railroad Company:


In behalf of Signal Maintainer Gerald Swaim with assigned headquarters at Tipton, Indiana, for eight (8) hours at his straight time rate of pay for work performed by Monon Railroad Signal forces at 16th, 17th and 19th Streets in Indianapolis, Indiana, on August 17, 1959, in addition to compensation for all work performed on other dates at the above locations by Monon Railroad Signal forces in violation of the current New York, Chicago and St. Louis Railroad Company Signalmen's Agreement.


FINDINGS: The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds and holds:


That the Carrier and Employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21,1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;


That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and


That hearing was waived and under date of September 13, 1961, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
