PARTIES TO DISPUTE:
BROTHERHOOD OF RAILROAD SIGNALMEN OF AMERICA
CHICAGO, ROCK ISLAND AND PACIFIC RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the System General Committee of
the Brotherhood of Railroad Signalmen of America on the Chicago, Rock Island
and Pacific Railroad Company that:
(a) The Carrier violated the current Signalmen's Agreement
when it changed the starting time of Leading Signalman D. 0. Anderson and Signal Helper R. E. Fowler, regular assignees to Signal Crew
No. 10, from 8:00 A. M. (their regularly established bulletined starting time) to 7:00 A. M.
(b) The Carrier now pay Leading Signalman D. O. Anderson
and Signal Helper R. E. Fowler at their respective punitive rates of
pay for one hour per day on each of the following dates: June 1, 4, 5,
6, 7, 8, 11, 12, 13, 14, 15, 18, 19, 20, and 21, 1956, and for

on June 22, 1956.
(c) This claim to cover all future dates that the claimants in
this dispute and other employes who may be assigned to Signal Crew
No. 10 are required to report for work prior to their established starting time of 8:00 A. M., in violation of the current Signalmen's Agreement.
FINDINGS: The Third Division of the Adjustment Board, after giving
the parties to this dispute due notice of hearing thereon and upon the whole
record and all the evidence, finds and holds:
That the carrier and employe involved in this dispute are respectively
carrier and employe within the meaning of the Railway Labor Act, as approved
June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of October
19, 1961, the parties jointly addressed a formal communication to the Secretary

of the Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
