STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the effective Agreement when, on or
about May 6, 1958, it assigned the work of relocating certain track:
at Mobile, Alabama to a General Contractor whose employes hold no
seniority rights under the provisions of this Agreement.
(2) Each employe holding seniority in the Track sub-department be allowed pay at his respective straight time rate for an equal
proportionate share of the total man-hours consumed by the contractor's forces in performing the work referred to in Part (1) of
this claim.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing thereon has been held and concluded. Under date of
October 23, 1961, the parties jointly addressed a formal communication to
the Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
