STATEMENT OF CLAIM: Claim of the General Committee of the Order
of Railroad Telegraphers on the New York Central Railroad (Eastern District), that:
1. Carrier violated the terms of the Agreement between the parties
when, acting without agreement, it removed from the employes
subject to said Agreement at the agency stations at Ansonia, Pa.,
Avis, Pa., Beaver Dam, N. Y., Beech Creek, Pa., Cedar Run, Pa.,
Cherry Tree, Pa., Clearfield, Pa., Dresden, N. Y., Dundee, N. Y.,
Elkland, Pa., Karthus, Pa., Jersey Shore, Pa., Knoxville, Pa.,
Lawrenceville, N. Y., Lock Haven, Pa., Lumbar, Pa., Mahaffey, Pa.,
Middlebury, Pa., Mill Hall, Pa., Penn Yan, N. Y., Phillipsburg,
Pa., Snow Shoe, Pa., Tioga, Pa., Watkins Glen, N. Y., Wellsboro,
Pa., Winburne, Pa., Woodland, Pa., and Westfield, Pa., the work
of checking, rating, preparing waybills, preparing expense bills,
collecting freight charges, and other work in connection with, and
incidental to, the handling of less than carload freight shipments
originating at and destined to said stations and transferring said
work to other stations and to employes not subject to the Agreement.
2. Carrier shall restore such work to the agency stations at Ansonia,
Pa., Avis, Pa., Beaver Dam, N. Y., Beech Creek, Pa., Cedar Run,
Pa., Cherry Tree, Pa., Clearfield, Pa., Dresden, N. Y., Dundee,
N. Y., Elkland, Pa., Kairthus, Pa., Jersey Shore, Pa., Knoxville, Pa.,
Lawrenceville, N. Y., Lock Haven, Pa., Lumber, Pa., Mahaffey, Pa.,
Middlebury, Pa., Mill Hall, Pa., Penn Yan, N. Y., Phillipsburg,
Pa., Snow Shoe, Pa., Tioga, Pa., Watkins Glen, N. Y., Wellsboro,
Pa., Winburne, Pa., Woodland, Pa., and Westfield, Pa., and to the
employes subject to the Agreement thereat from whom it was
unilaterally taken.
FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was cmtified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing thereon has been held and concluded. Under date of August
22, 1961, the parties jointly addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
