BROTHERHOOD OF RAILROAD SIGNALMEN OF AMERICA
CHICAGO, ROCK ISLAND AND PACIFIC RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the
General Committee
of the
Brotherhood of Railroad Signalmen of America on the Chicago, Rock Island
and Pacific Railroad Company that:
(a) The Carrier violated the Signalmen's Agreement, particularly Rules 22, 23, and 28, when it refused Signal Maintainer D. J.
Lanfier, whose headquarters is at Hennessey, Oklahoma, and Signal
Maintainer H. Klein, whose headquarters is at Medford, Oklahoma,
actual necessary expenses which they incurred on August 9, 1957, at
Enid, Oklahoma where they had traveled, at the direction of the
Carrier, to present themselves for a re-examination in accordance
with Rule 82 of the current
agreement.
(b) Signal Maintainer D. J. Lanfier be reimbursed in the amount
of one dollar and two cents ($1.02) and that Signal Maintainer H.
Klein be reimbursed in the amount of one dollar and seventeen cents
($1.17), which represents the actual expenses incurred by each and
amount claimed on this Carrier's Form G-13, which was denied by the
Carrier under date of August 15, 1957.
FINDINGS: The Third Division of the Adjustment Board, upon the
whole record and all the evidence, finds and holds:
That the Carrier and Employe involved in this dispute are respectively
carrier and employe within the meaning of the Railway Labor Act, as approved
June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing was waived and under date
of November 15, 1961, the parties
jointly addressed a formal communication to the Secretary of the Third
Division requesting withdrawal of this case, which request is hereby granted.
