STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the effective Agreement when it
assigned District Maintenance Gang Laborers, who were regularly
assigned to District Gang No. 17 on the Fourth District, to perform
service on the Third District at Grand Rapids, Minnesota on January 6 and 7, 1958.
(2) District Maintenance Gang Laborers Leslie T. Leppanan,
James W. Vadnois, Prooper Clark, Thomas McCauley, Floyd Boettcher, John Alapera and Charles Lutterman, who were then furloughed from the Third District, each be allowed sixteen hours'
straight time pay because of the violation referred to in Part (1)
of this claim.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex part by the complainant party; and
That hearing thereon has been held and concluded. Under date of
December 15, 1961, the parties jointly addressed a formal communication to
the Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
