BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
THE BELT RAILWAY COMPANY OF CHICAGO
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(a) Carrier violated the rules of the Clerks' Agreement when
effective March 16, 1958, it unilaterally removed one and one-half
hours work from Class 1 employes in Seniority District No. 9 and
assigned it to Class 2 employes holding seniority in District No. 2.
(b) Class 1 employes, namely J. B. Heiser, W. Powers, J. A.
Wojik, M. A. Steed, H. Cammack, A. H. Skinner, their regularly
assigned relief and/or successor (s), if there be any, be compensated
for a proportionate part of the actual time involved, or fifteen
minutes additional compensation at the rate of time and one-half,
account of being denied the right to perform and be paid for this
work.
FINDINGS:
The Third Division of the Adjustment Board, upon the
whole record and all the evidence, finds and holds:
That the Carrier and Employes involved in this dispute are respectively
carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon was waived by the parties and under date of
December 6, 1961, the parties jointly addressed a formal communication to

the Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.

- Case dismissed.
