STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(1) Carrier violated the provisions of the current Clerk's
Agreement, when on September 13, 1958, it arbitrarily changed the
status of Position #203 from a six day assignment to a five day
assignment and concurrently there with assigned the work attached
to the handling of bills of lading for outbound industrial traffic to
the incumbent of Position #206, a lower rated position, on Saturdays.
(2) That the occupants of Position #206, namely L. Ramey
and E. Egan, be compensated for the existing differential between
the assigned rate of pay of Position .#203 and the regularly assigned
rate of pay of Position #206 for each Saturday, effective September
13, 1958 and continuing until March 4, 1959, when the practice was
discontinued.
FINDINGS:
The Third Division of the Adjustment Board, upon the
whole record and all the evidence, finds and holds:
That the Carrier and Employe involved in this dispute are respectively
carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing thereon was waived by the parties and under date of
December 6, 1961, the parties jointly addressed a formal communication to
the Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
