PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
THE BELT RAILWAY COMPANY OF CHICAGO
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the Clerk's Agreement at its South
District Yard, beginning Thanksgiving Day, November 27, 1958,
when it nominally abolished District Yard Clerk Positions Nos. 184,
185, 186, Relief positions Nos. 2 and 7 and concurrently therewith
assigned the duties of each to extra and furloughed employes, for a
period of nine (9) consecutive days thereafter, twenty-four hours
per day.
(2) Employes adversely affected be compensated for wage
losses sustained, to wit:
(a) C. White for four (4) hours additional compensation for Sunday, November 30, 1958, which otherwise
would have been his assigned rest day.
(b) H. W. Anderson for two and one half (2s%)
days pay for Thanksgiving Day, Thursday, November 27,
1958, which he would otherwise have worked; for one (1)
days pay for Friday, November 28, 1959, which he would
otherwise have worked; and for four (4) additional hours'
compensation for Monday, December 1, 1958 and Tuesday,
December 2, 1958.
(c) All other employes, namely L. Warfield, W. Foster, J. Mueller and E. Harder, displaced as a result of the
abolishments be compensated for wage losses sustained including holiday pay, for the period of November 27, 1958
until December 6, 1958.
FINDINGS:
The Third Division of the Adjustment Board, upon the
whole record and all the evidence, finds and holds:

That the Carrier and Employes involved in this dispute are respectively
carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon was waived by the parties and under date of
December 6, 1961, the parties jointly addressed a formal communication to
the Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
AWARD
Case dismissed.
