PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
THE BELT RAILWAY COMPANY OF CHICAGO
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood (GL-4973) that:
(a) The Carrier violated the terms of the current Clerk's
Agreement when on April 20, 1960, it unilaterally removed approximately six hours of clerical work in connection with the preparation
of reports having to do with the Rail to Water operations, from the
seniority district of the Car Accountant, Clearing, Illinois, to the
seniority district of the South Chicago Agency, South Chicago, Illinois.
(b) Employes affected, specifically, E. Benbam, presently
furloughed, be compensated for all wage losses sustained.
(c) The senior employe, or successful applicant in Seniority
District #3, who normally would have applied for the position transferred, be compensated for the existing differential between the rate
of pay of the position required to work and the rate of pay of the
position advertised under Bulletin #2 to the employes in Seniority
District #9, until correction is made.
(d) The clerical work in connection with the preparation of
reports having to do with the Rail to Water operation be immediately
returned and restored to the seniority district of the Car Accountant,
Clearing, Illinois.
FINDINGS:
The Third Division of the Adjustment Board, upon the
whole record and all the evidence, finds and holds:
That the Carrier and Employe involved in this dispute are respectively
carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;

That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon was waived by the parties and under date of
December 6, 1961, the parties jointly addressed a formal communication to
the Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
AWARD
Case dismissed.
