PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
GULF, MOBILE AND OHIO RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The Order
of Railroad Telegraphers on the Gulf, Mobile and Ohio Railroad, that:
1. Carrier violated the agreement between the parties when it
failed and refused to pay W. E. Conner, Agent-Telegrapher at Ackerman, Mississippi, and C. B. Holcomb, Agent-Telegrapher at Philadelphia, Mississippi, for work performed when called
outside their regular
work period.
2. Carrier shall compensate W. E. Conner in the amount of a
minimum call payment on October 8, 1958, and on October 10, 1958,
and compensate C. B. Holcomb in the amount of a minimum call payment on November 24, 1958.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of December 21, 1961, the Organization addressed a formal communication to the
Executive Secretary of the Third Division, requesting withdrawal of this case
from further consideration by the Division. Under date of December 6, 1961,
the Carrier addressed a formal communication to the Executive Secretary of
the Third Division concurring in the Organization's request for withdrawal
of the case from the Board. The request of the parties is hereby granted.
AWARD
Claim dismissed.
