STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood:
1. That Carrier's refusal to upwardly adjust rates of pay of
two of the remaining four Rate and Revising Clerks' positions on
office of A. F. & P. A., Chicago, concurrently with rearrangement
of the rate revising work following abolishment of the fifth Rate
and Revising Clerk's position on August 19, 1957 is in violation of
the rules of the parties agreement.
2. That rates of the two lower rated positions, namely that
assigned to Miss B. Byrne at rate $17.60 per day and Mrs. J. Wolfel
at rate $17.34 per day be adjusted to rate $18.33 per day or that
paid the other two Rate and Revising Clerks, retroactive to August
19, 1957.
FINDINGS:
The Third Division of the Adjustment Board, upon the
whole record and all the evidence, finds and holds:
That the Carrier and Employe involved in this dispute are respectively:
carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon was waived by the parties and under date of
December 1, 1961, the parties jointly addressed a formal communication to
the Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
