STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railroad Signalmen on the Union Railway Company (Memphis)
In behalf of C. V. Fleming and D. R. Ryles, Signalman, Union Railway, rate of pay for each man $531.60 per month, based on 211 hours; for thirty (30) hours signal work performed by four (4) B and B laborers and one (1) assistant foreman, who are not covered by the current Sighalmen's Agreement, on April 1, 1960. The signal work consisted of digging and filling ditches for pipe across Rozelle Street, and switchlight wire between switches east of Rozelle Street. The time claimed for C. V. Fleming on April 1, 1960, amounts to 8 hours at the pro-rata rate and 7 hours at the time and one-half rate. The time claimed for D. R. Ryles on April 1, 1960, amounts to fifteen (15) hours at the time and one-half rate.
FINDINGS: The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds and holds:
That the Carrier and Employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;
That the dispute teas certified to the Third Division of the adjustment Board ex parte by the complainant party; and
That hearing thereon was waived and under date of June 23, 1962, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
