PARTIES TO DISPUTE:



STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railroad Signalmen on the Union Railway Company (Memphis):


On behalf of C. V. Fleming and D. R. Ryles, Signalmen, Union Railway, rate of pay for each man $544.25 per month based on 211 hours; for twenty (20) hours of signal work consisting of digging and filling ditches for switch light wires at Sargent Yard being performed by B and B employes, who are not covered by the Signalmen's Agreement on February 27, 1961. The time claimed for C. V. Fleming; eight (8) hours at pro rata rate, and two (2) hours at time and one-half rate for February 27, 1961. The time claimed for D. R. Ryles: ten (10) hours at time and one-half rate for February 27, 1961.


FINDINGS: The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds and holds:


That the Carrier and Employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;


That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and


That hearing thereon was waived and under date of June 23, 1962, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
