PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
SEABOARD AIR LINE RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the Seaboard Air Line Railroad that:
Case No. 1
1. Carrier violated the Agreement between the parties when and
because on the 25th day of May, 1960, it required or permitted Brakeman E. D. Grainger to handle (receive, copy and deliver) train order
No. 79 addressed to C&E Train No. 92 at Gravelton, N. C.
2. Carrier shall be required to compensate V. B. Richardson,
Clerk-Operator, Gravelton, N. C., for one call-2 hours at the overtime rate of May 25, 1960, account the aforesaid violation.
Case No. 2
1. Carrier violated the Agreement between the parties when and
because on the 3Td day of June, 1960, it required or permitted Brakeman E. D. Grainger to handle (receive, copy and deliver) train order
No. 95 addressed to C&E Train No. 92 at Gravelton, N. C.
2. Carrier shall be required to compensate V. B. Richardson,
Clerk-Operator, Gravelton, N. C., for one call- 2 hours at the overtime rate for June 3, 1960, account the aforesaid violation.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of August
23, 1962, the parties jointly addressed a formal communication to the Secretary
of the 'Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
