PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
GULF, COLORADO AND SANTA FE RAILWAY COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the Gulf, Colorado & Santa Fe Railway,
that:
1. The Agreement between the parties was violated when F. L.
Bush was unjustly dismissed from service as a result of an investigation conducted August 30, 1960.
2. Carrier shall now restore F. L. Bush to service with seniority
rights unimpaired and compensate him for salary lost, retroactive to and including August 31, 1960.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and
That hearing was waived, and under dates of October 23, 1962 and
October 26, 1962 the respective parties advised the Secretary of the Third
Division of their desire to withdraw this case from further consideration by
the Division, which request is hereby granted.
AWARD
Claim dismissed.
