PARTIES TO DISPUTE:
BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
CENTRAL OF GEORGIA RAILWAY COMPANY
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the agreement when, on July 1, 1963,
it assigned the work of Coal Chute and Locomotive Fuel Oil Station
Foreman at Industry Yard, Atlanta, Georgia, to others not covered
by the effective agreement, and as a result thereof:
(2) Mr. Jack G. Goins, Ident. No. 30751, be paid at his straight
time rate of pay, beginning with July 15, 1963 and to continue until
the settlement of this claim.
OPINION OF BOARD:
This case involves the same parties and issues
as in Award No. 15032. For reasons stated in that Award we find and award
FINDINGS: The Third Division of the Adjustment Board, after giving
the parties to this dispute due notice of hearing thereon, and upon the whole
record and all the evidence, finds and holds:
That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning of the Railway Labor Act,
as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein; and
That Central violated the Agreement.
AWARD
Paragraph 1 of Claim sustained.
Paragraph 2 of Claim sustained to extent of formula prescribed in II (C)
of Opinion in Award No. 15028.
