PARTIES TO DISPUTE:
BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
CENTRAL OF GEORGIA RAILWAY COMPANY
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the agreement when, on July 15, 1963,
it required and/or permitted Mr. H. F. Hogg to be displaced from
his assignment as Coal Chute and Locomotive Fuel Oil Station Foreman at Albany, Georgia, and as a result thereof:
(2) Mr. H. F. Hogg, Ident. No. 38635, be paid at his straight
time rate of pay beginning with July 15, 1963 and to continue until
the settlement of this claim.
OPINION OF BOARD: This case involves the same parties and issues
as in Award No. 15032. For reasons stated in that Award we find and award
FINDINGS: The Third Division of the Adjustment Board, after giving
the parties to dispute due notice of hearing thereon, and upon the whole
record and all the evidence, finds and holds:
That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning of the Railway Labor Act,
as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein; and
That Central violated the Agreement.

Paragraph 1 of Claim sustained.
Paragraph 2 of Claim sustained to extent of formula prescribed in II (C)
of Opinion in Award No. 15028.
