STATEMENT OF CLAIM: The Petitioner, Claude W. Beck, is an employe of the Railway Express Agency and a member in good standing of the Brotherhood of Railway and Steamship Clerks. The Petitioner became employed by the carrier on June 25, 1941. At a meeting of the Patrick Henry Lodge of the Brotherhood, it was decided that the Petitioner had resigned and the management terminated the petitioner's initial seniority date of June 25, 1941, on the basis that the Petitioner voluntarily left the service of the Railway Express Agency on September 4, 1943. Subsequently, the Petitioner was awarded a seniority date of June 23, 1944. The petitioner, on numerous occasions, protested to the various officials of the Brotherhood and to persons connected with management, the first complaint being in a letter dated July 7, 1944, to former General Chairman Galloway Monteith. On August 8, 1962, the Grand Executive council of the Brotherhood determined that the decision of the Grand President, entered on February 1, 1962, should be sustained. This decision by the Grand President left the Petitioner's seniority date as June 23, 1944. It is a result of this decision that the Petitioner seeks an award.
OPINION OF BOARD: The Claim was not handled in the usual manner on the property as required by Section 3, First (i) of the Railway Labor Act. Therefore, we are compelled to dismiss.
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:
That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
That the Claim must be dismissed for failure to comply with Section 3, First (i) of the Railway Labor Act.
