STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood (GL-6720) that:

1. The Carrier violated the Clerks' Agreement when on March 17, 1969, it suspended Clerk Gray from actual service for a period of thirty (30) days.

2. Clerk Gray shall now be compensated for all wage losses sustained and that his record be cleared of the alleged charge.

OPINION OF BOARD: Claimant was charged with violation of Rule J of Carrier's Book of Rules. Elfter hearing he was found guilty as charged and was suspended for thirty (30) days.

Petitioner in its submissim makes the following admission:

"Here the record is clear that Claimant had a fair hearing which produced substantial evidence to justify the finding of violation of Rule J."

We find: (1) Claimant vras afforded due process; (2) the findings of guilt as charged are supported by substantial evidence; and (3) the discipline assessed was reasonable. 'We, therefore, must deny the Claim.

FINDINGS: The Third :Division of the Adjustment Board, upon the whole record and all the evidence, finds and holds:

That the parties waived oral hearing;

That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning of the Railway Labor Act, as approved June 21, 1934;

That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
