STATEMENT OF CLAIM: Claim of the General Committee on the Transportation-Com
munication Employees Union on the Southern Pacific Company
(Lines in Texas and Louisiana), that:
1. Carrier violated the Agreement between the parties when it permitted or required the Star Age
2. Carrier shall compensate D. L. Horak for a minimum call payment.
Claim II
1. Carrier violated the Agreement between the parties when it permitted or required a clerk at B
record on October 26, 1965.
2. Carrier shall compensate W. P. Bourgeois for a minimum call payment.
OPINION OF BOARD: The parties herein, the issues, and the contention of the
parties are the same as were involved in Award No. 14226.
We have reviewed that Award and do not find it to be palpably erroneous. It is,
therefore, controlling herein, and the claim will be denied.
FINDINGS: The Third Division of the Adjustment Board, upon the whole record and
all the evidence, finds and holds:
That the pacties waived oral hearing;
That the Carrier and the Employes involved in this dispute are
respectively Carrier and Employes within the meaning of the Railway Labor Act,
as approved June 21, 1934;

That this Division of the Adjustment Board has jurisdiction over
the dispute involved herein; and
That the Agreement was not violated.

Claim denied.
