PARTIES TO DISPUTE:
(Chicago, Milwaukee, St. Paul and Pacific Railroad Company
STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood (GL-6587)
that:
1) Carrier violated the Clerks' Rules Agreement, and the February 7,
1965 Agreement, particularly Article III and VIII thereof, by assigning and/or
permitting the Agent at Mankato, Minnesota to perform Bill Clerk work at that
station.
2) Carrier shall be required to restore the billing and revising work
at Mankato to the scope of the Clerks' Agreement and the employes covered thereby.
3) Carrier shall be required to compensate employe Robert F. Johnson
an additional eight (8) hours at the straight time rate of Position No. 59260
and three (3) hours at the time and one-half rate of Position 59260 for September
5, 1967 and all subsequent days the violation continues.
OPINION OF BOARD: The dispute involved in this claim is a continuation of the
dispute covered in our Award 19325. We will dispose of
this claim on the basis,of Award 19325.
_FINDINGS: The Third Division of the Adjustment Board, upon the whole record and
all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the Employes involved in this dispute are
respectively Carrier and Employes within the meaning of the Railway Labor Act,
as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute herein; and
That the Agreement was not violated.
