STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railroad


On behalf of Signal Maintainer L. C. Irby, Jr. for 7.9 hours at his punitive rate of pay account called to help correct signal trouble at North Little Rock, 4:30 A.M. to 7:00 A.M., November 14, 1969, at 7:40 A.M. to 1:00 P.M., November 16, 1969.


OPINION OF HOARD: Claimants work was other than ordinary maintenance.



Claimant is a monthly rated employee. Rule 600 c contemplates other than regular work may be done by a monthly rated employee without extra compensation.

In the current case, position and territory mean the same thing. The shift is not the controlling consideration.





That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning of the Railway Labor Act, as approved June 21, 1934;

That this Division of the Adjustment Hoard has ,jurisdiction over the dispute involved herein; and





        Claim denied.
