STATEMENT OF CLAIM: Claim of the reneral Committee of the Brotherhood of
Railroad Signalmen on the Houston Belt & Terminal Railway Company that:
Signal Inspector I. D. Baxley, Signal Maintenance Foreman G. S.
Drake, Signal Maintainer D. J. Hill, and Signal Maintainer W. H. Guinn should
be paid one and one-half times their respective straight time hourly rates
for 4, 4, 15, and 10.7 hours, respectively, which is due them under Rule 310(a)
of the Signalmen's Agreement for work they performed on a Holiday, July 4, 1970.

OPINION OF
BOARD: We
will follow what was held in Award 18962 which involved
a dispute between these same parties and deny the claim.
FINDINGS: The Third Division of the Adjustment Hoard, upon the whole record
and all the evidence, finds and holds:
That the parties waived oral heaIiRR;
That the Carrier and the Employes involved in this dispute are
respectively Carrier and EmT)loyes within the meaning of the Railway Labor
Act, as approved June 21, 1934;
That this Division of the Adjustment Hoard has ,jurisdiction over
the dispute involved herein; and
That the Agreement was not violated.
