: Claim of the General Committee of the Brotherhood of Railroad
Signalmen on the Louisville and Nashville Railroad Company:
On behalf of Signal Maintainer K. E. Cheatwood, for sixteen (16) hours
at his respective overtime rate, account Electricians wiring compressor #2 at Boyle·s
Yard, Alabama. Time and dates involved include eight hours per day on the folb)wint:
dates--October 14 and 15, 1969.
This is a direct violation of the Signalmen's Agreement, particularly Rule
1. Scope of the Agreement, which specifically assigns this type of work to our
Signal forces. (Carrier's File: G-304-12; G-304)
OPINION OF BOARD
: In all material respects the issues in this case are identical
to issues raised between the same parties in Award 19447. Consequently, the herein claim has been co
opinion therein.
FINDINGS
: The Third Division of the Adjustment Board, upon the whole record and
all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the Employes involved in this dispute are
respectively Carrier and Employes within the meaning of the Railway Labor Act, as
approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein; and
That the Agreement was violated.
