STATEMENT OF CLAIM
: Claim of the System Committee of the Brotherhood (GL-7056)
that:
(a) Carrier violated the Agreement between the parties when it
refused to permit Mr. D. Bennett, Clerk, Tifft Terminal, Buffalo, N. Y., to
work the last two (2) days of his regular assignment, Monday and Tuesday,
June 22nd and June 23rd, 1970, as Relief #1 at Tifft Terminal.
(b) Carrier shall now be required to compensate Mr. D. Bennett for
these two (2) days at pro-rata June 22nd and June 23rd, 1970.
OPINI
ON OF BOARD: The issue presented by this claim has been adjudicated by
this Board in numerous cases. For reasons stated in our
Award No. 19622 (issued February 27, 1973) we will sustain the instant claim.
FINDINGS
: The Third Division of the Adjustment Board, upon the whole record
and all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the Employes involved in this dispute are
respectively Carrier and Employes within the meaning of the Railway Labor
Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over
the dispute involved herein; and
The Agreement was violated.
