(Illinois Central Gulf Railroad PARTIES TO DISPUTE:(


STATEMENT OF CLAIM: Whether the company violated the current Signalmen's
Agreement when it permitted Commonwealth Edison Company to lay an inductively shielded underground cable on company property near Kankakee, Illinois, in connection with its furnishing electrical service to nearby commnities.

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and

That under date of November 27, 1974 the complainant party addressed a formal communication to the Executive Secretary of the Third Division, concurre in by the Respondent, requesting withdrawal of this case from further consideration by the Division,
