STATEMENT OF CLAIM: Claim of Employee:
1. The Burlington Northern, Inc., unjustly, improperly, and without
supporting their position, suspended Mr. Jenaro Cisneros from service thirty

working days commencing October 20,
1972,
to and including November
30,
1972.
2. That accordingly the Burlington Northern, Inc., be ordered to
make Jenaro Cisneros whole, compensating him for all time lost, and removing
all entries from his personal record referring to this incident.
FINDINGS: The Third Division of the Adjustment Board, upon the whole record
and all the evidence, finds that:
The Carrier and the Employes involved in this dispute are respectively
Carrier and Employes within the meaning of the Railway Labor Act, as approved
June 21,
1934;
This Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
This dispute was submitted ex parte by the complainant party and
hearing was waived. Under date of December
18, 1974,
the parties jointly
addressed a formal communication to the Secretary of the Third Division requesting
withdrawal of this case, which request is hereby granted.

Case dismissed.
